Use Of Information Notice
This notice explains how Ark Life Assurance Company Limited (“Ark Life”), being the data controller, and AIB Group (together “we”, “us” or “our”) will use information provided by you in connection with your policy. Ark Life is a subsidiary of Aviva Life Holdings Ireland Limited, a joint venture company between Aviva Group Ireland plc. and Allied Irish Banks, plc. References to ‘AIB Group’ mean Allied Irish Banks, plc, its Irish subsidiaries and associated companies from time to time.
The information provided by you and third parties in connection with your policy, will be held by us on both computer and manual databases and/or in other ways. We will hold, use, seek, disclose and process this information for the purposes of (a) underwriting and administering the products and services we supply to you and any future agreements we may have with you; (b) for any other specific purposes where you have given specific consent to do so; (c) to carry out statistical and market research; (d) to comply with any applicable legal or regulatory obligations; or (e) for our other legitimate business interests.
In connection with these purposes, information may be shared, both inside and outside the European Economic Area, with our other insurance and financial services companies, with Aviva Group Ireland plc/ Aviva Group companies and third parties such as reinsurance companies, medical practitioners, the Irish Insurance Federation, trustees/administrators and sponsoring employers of pension plans, other insurance and financial services companies, data processors and our service providers such as those to whom we outsource certain business operations, professional advisers, private investigators who may be instructed to investigate a claim, reputable external agencies and as required by law.
To assist in preventing, detecting and/or protecting our customers and ourselves from theft and fraud, we may also use information you provide to make searches of our records. AIB participates in the Irish Credit Bureau (“ICB”) and may share information about you with the ICB and indirectly through the ICB with other ICB participants for fraud prevention purposes. If you give us false information or fail to disclose information and we suspect fraud, we will record this. We also participate in the Life Assurance Registry, which is operated by The Irish Insurance Federation for the purpose of sharing of information among insurance companies as a check against non-disclosure.
In the event of your application not proceeding or your policy ceasing, information provided in connection with such may be retained for as long as is permitted by law and may be shared as outlined above where applicable.
Where sensitive personal data, for example data relating to your physical or mental health or condition, are provided by you or on your behalf, access to and disclosure of this information will be restricted to that necessary for the purposes set out above, in particular for administering contracts of insurance/products requested by you (including underwriting, processing, claims handling, reinsurance, protection against non disclosure and fraud prevention).
From time to time, we may record your telephone calls for quality assurance purposes.
You must ensure that you have fully explained to each person whose information has been provided to us in connection with your policy, the purposes and use for which that information has been provided and how the information may be used, in the same detail as set out in this form and that each person has explicitly consented to such.
Where you have already given permission to do so, AIB Group may use your personal data for the purpose of offering you other products and services, including those available from other companies in AIB Group and carefully selected third parties, which AIB Group thinks may be of interest to you. If you wish to change your preferences at any time, please write to us to let us know at your local AIB branch or the Data Protection Unit, Allied Irish Banks, p.l.c. Bankcentre, Ballsbridge, Dublin 4.
You have the right to request access to the personal data we hold about you by sending a written request together with the applicable fee (currently €6.35) in respect of information held:
(i) by Ark Life to , The Compliance Manager, Ark Life, One Park Place, Hatch Street, Dublin 2; or
(ii) by AIB Group to, your local AIB branch or to the Data Protection Unit, Allied Irish Banks, p.l.c., Bankcentre, Ballsbridge, Dublin 4.
If you believe there may be inaccuracies identified in the information held about you, then you can contact Ark Life and AIB Group as set out above to have such corrected, to block certain uses or object to the processing of your personal data.
If you decide to proceed with an application or have any other communication with Ark Life and/or AIB Group through or in relation to our products and services, you accept the use by Ark Life and AIB Group of your personal data as indicated above. In particular you acknowledge and explicitly consent to the arrangements in relation to sensitive personal data as indicated.
